Terms and Conditions – Waiver

WAIVER, INDEMNITY, AND RELEASE OF LIABILITY

Passenger expressly acknowledges and agrees that the airboat tour involves some risks, and passenger hereby knowingly, freely, and voluntarily assumes all risk and liability for any death, bodily injury, damage, property damage, harm, loss and/or injury that results or may result directly or indirectly from Passenger’s or Passenger’s child/ward’s participation in the activity described herein, and further agrees to release, waive, discharge, and covenant not to sue The Clint Corporation, Bridges Everglades, LLC d/b/a Everglades Holiday Park, BigBig, Inc., Everglades VIP, LLC, Everglades Holiday Park, Inc., and Broward County, their respective officers, agents, employees, contractors, and volunteers (all for the purposes herein referred to as the “Releasees”) from any and all liability and causes of action whatsoever which Passenger, Passenger’s heirs, legal representatives and assigns may have or ever come to have against any of the Releasees due to Passenger’s and/or Passenger’s child/ward’s participation in the activity described herein, whether caused in whole or in part by the negligence of Broward County or the Releasees. Passenger further agrees to indemnify and hold harmless the Releasees from any and all liability, including all fees and costs, resulting from claims, causes of action, or losses sustained by third parties arising out of actions or alleged actions in connection with Passenger’s and/or Passenger’s child/ward’s participation in the activity described herein.
